2. Service Description

  • Performance optimization and maintenance

SaaS Development

  • Sales AI agent implementation

  • Machine learning model development

3. User Responsibilities

As a user of our services, you agree to:

  • Provide accurate and complete information when requested
  • Maintain the confidentiality of your account credentials
  • Use our services only for lawful purposes
  • Comply with all applicable local, state, and federal laws
  • Respect intellectual property rights
  • Not attempt to gain unauthorized access to our systems

4. Payment Terms

Pricing and Fees

  • All prices are quoted in USD unless otherwise specified
  • Fees are based on project scope, complexity, and timeline
  • Custom pricing is provided for enterprise solutions
  • Additional charges may apply for scope changes or rush orders

Payment Schedule

  • Project payments typically require 50% upfront, 50% upon completion
  • Monthly retainer services are billed in advance
  • Developer rental services are billed weekly or monthly
  • Late payments may incur additional charges of 1.5% per month

Refund Policy

Refunds are considered on a case-by-case basis. Generally, work completed and delivered cannot be refunded. Disputes should be raised within 30 days of project delivery.

5. Intellectual Property Rights

Client Ownership

Upon full payment, clients retain ownership of:

  • Custom code developed specifically for their project
  • Design assets created exclusively for their brand
  • Content and data provided by the client
  • Final deliverables as specified in the project agreement

Eye4Tech Ownership

Eye4Tech retains ownership of:

  • Proprietary frameworks, tools, and methodologies
  • Pre-existing code libraries and templates
  • General knowledge and experience gained during projects
  • The right to showcase work in portfolios (with client consent)

6. Service Level Agreement

Response Times

  • Critical issues: 4 hours response time
  • High priority issues: 24 hours response time
  • Standard inquiries: 48 hours response time
  • General support: 72 hours response time

Availability

  • Services are available 24/7 with 99.9% uptime target
  • Scheduled maintenance will be announced 48 hours in advance
  • Emergency maintenance may occur with minimal notice

7. Confidentiality and Data Protection

Eye4Tech is committed to protecting client confidentiality:

  • Access to client data is limited to authorized personnel only
  • Regular security audits and compliance checks are performed
  • Client data is never shared with third parties without consent

We comply with GDPR, CCPA, and other applicable data protection regulations.

8. Limitation of Liability

Eye4Tech's liability is limited as follows:

  • Total liability shall not exceed the total amount paid by the client
  • We are not liable for indirect, incidental, or consequential damages
  • We are not responsible for third-party service failures
  • Force majeure events are excluded from liability claims
  • Client is responsible for data backups and disaster recovery planning

This limitation applies to the fullest extent permitted by applicable law.

9. Termination

Termination by Client

  • 30 days written notice required for ongoing services
  • Immediate termination allowed with penalty fees
  • All outstanding payments must be settled
  • Work completed up to termination date will be delivered

Termination by Eye4Tech

  • Non-payment of fees for 30+ days
  • Breach of terms and conditions
  • Illegal or unethical use of services
  • Failure to provide necessary project materials or cooperation

10. Governing Law and Dispute Resolution

These terms are governed by the laws of the jurisdiction where Eye4Tech is incorporated.

Dispute Resolution Process

  • Initial attempt at resolution through direct negotiation
  • Mediation through an agreed-upon neutral third party
  • Binding arbitration if mediation fails
  • Legal proceedings as a last resort

All disputes must be raised within one year of the incident that gave rise to the dispute.

11. Changes to Terms

Eye4Tech reserves the right to modify these terms at any time. Changes will be communicated through:

  • Email notification to registered users
  • Website announcement on our homepage
  • Updated terms posted on our website
  • Direct communication for significant changes

Continued use of our services after changes constitutes acceptance of the new terms.
